This website offers visitors the ability to book services (i.e., courses, classes, retreats, events) and purchase resources (i.e., digital downloads and materials) offering deep listening practice and/or engagement with nature. By accessing or using the website, you approve that you have read, understood, and agree to be bound by these Terms.

Welcome to the Terms and Conditions of Use Agreement (“Terms”). This is a legal agreement between YOU and Thin Place, LLC. (thinplacecommunity.com) with a mailing address in Newnan, Georgia, that describes the terms and conditions that govern your use of Thin Place, LLC internet website, and the services provided thereon. Thin Place, LLC is sometimes referred to in this Agreement as “Thin Place,” “we,” “our,” or “us.”
IF YOU CHOOSE TO USE THE WEBSITE, ITS APPLICATIONS, OFFERINGS, PROGRAMS, AND EDUCATIONAL/RESOURCE MATERIALS, YOU WILL BE AGREEING TO ABIDE BY ALL OF THE TERMS AND CONDITIONS SET FORTH IN THIS AGREEMENT. IF ANY OF THESE RULES OR ANY FUTURE CHANGES ARE UNACCEPTABLE TO YOU, DO NOT ACCESS OR USE THIS WEBSITE. Commercial Terms
When buying an item, you agree that: (i) you are responsible for reading the full item/service listing before making a commitment to buy it: (ii) you enter into a legally binding contract to purchase an item when you commit to buy an item and you complete the check-out payment process.
The prices we charge for using our services and for our products are listed on the website. We reserve the right to change our prices for products displayed at any time, and to correct pricing errors that may inadvertently occur. The fee for Membership services (i.e., “Partner” plans) and any other charges you may incur in connection with your use of the service, such as taxes and possible transaction fees, will be charged on a monthly basis to your payment method.
Return and Refund Policy
Thin Place, LLC is committed to supporting individuals and communities in ways that honor the work that we do. Therefore, we offer a 100% Satisfaction Guarantee for services/offerings and resources/products that we create. If you are unsatisfied with our products or services for any reason, contact us at office@thinplacecommunity.com within 6 months of the purchase of a digital download/resource or one month of completion of a service/offering for a full refund.
If a service/offering is cancelled by Thin Place for any reason, you will be offered the full or prorated amount of the service that you did not receive.
Retention of Right to Change Offering
We may, without prior notice, change the services; stop providing the services or any features of the services we offer; or create limits for the services. We may permanently or temporarily terminate or suspend access to the services without notice and liability for any reason, or for no reason.
Ownership of Intellectual Property, Copyrights and Logos
The Service and all materials therein or transferred thereby, including, without limitation, software, images, text, graphics, logos, patents, trademarks, service marks, copyrights, photographs, audio, videos, music and all Intellectual Property Rights related thereto, are the exclusive property of Thin Place, LLC. Except as explicitly provided herein, nothing in these Terms shall be deemed to create a license in or under any such Intellectual Property Rights, and you agree not to sell, license, rent, modify, distribute, copy, reproduce, transmit, publicly display, publicly perform, publish, adapt, edit or create derivative works thereof.
Resources (i.e., digital downloads) purchased for use by groups are restricted to downloading copies only for the number of participants indicated at time of purchase.
Except as expressly authorized by us through signed written consent, you agree not to sell, rewrite, modify, redistribute, create derivative works, or rent any part of any information presented to you through Thin Place/the website, in whole or in part. You may not remove any copyright notices from our materials. We reserve all other rights not granted in these Terms.
Right to Suspend or Cancel User Account and Services
We may permanently or temporarily terminate or suspend your access to the service without notice and liability for any reason, including if in our sole determination you violate any provision of these Terms or any applicable law or regulations. You may discontinue use and request to cancel your account and/or any services at any time. Notwithstanding anything to the contrary in the foregoing, with respect to automatically-renewed subscriptions to paid services, such subscriptions will be discontinued only upon the expiration of the respective period for which you have already made payment.
Indemnification
You agree to indemnify and hold harmless Thin Place, LLC (thinplacecommunity.com) as well as any of our affiliates, agents, contractors, companies, employees, successors, and licensees, as applicable, from and against any and all claims, causes of action, damages, liabilities, costs, and expenses, including legal fees and expenses, arising out of or related to our offering(s) and your use of this website (thinplacecommunity.com) or any products or courses listed on the site.
Limitation of liability
To the maximum extent permitted by applicable law, in no event shall Thin Place, LLC, be liable for any indirect, punitive, incidental, special, consequential or exemplary damages, including without limitation, damages for loss of profits, goodwill, use, data or other intangible losses, arising out of or relating to the use of, or inability to use, the information, products, materials, or services that you request or receive through or on our website and its content.

Preference of Law and Dispute Resolution
These Terms, the rights and remedies provided hereunder, and any and all claims and disputes related hereto and/or to the services, shall be governed by, construed under and enforced in all respects solely and exclusively in accordance with the internal substantive laws of the United States of America, and the state of Georgia, without respect to its conflict of laws principles. Any and all such claims and disputes shall be brought in, and you hereby consent to them being decided exclusively by a court of competent jurisdiction located in the state of Georgia, USA. The application of the United Nations Convention of Contracts for the International Sale of Goods is hereby expressly excluded.

Participation in In-Person or Online Services

Payment Policy
Payment for Services are required in full via credit card at the time of online registration.
Payment for “Member” services (i.e., Membership Plans) will be charged on a monthly basis per your payment method upon registration. Member services may be cancelled by you at any time. Please note, this does not cancel your Plan immediately, rather your Plan simply does not renew at the end of the subscription period.
Failed payments will automatically cancel your plan. Please be sure to keep credit card information up to date to ensure uninterrupted continuation of services.
Cancellations and Refunds
Cancellation by Thin Place:
Thin Place reserves the right to cancel classes and events for any reason. In the unfortunate circumstance of a cancellation, registration deposits and payments will be refunded.
Cancellation by Customer:
Half-Day or Single-Day Retreats, Events, Workshops, Hikes, Classes, and Courses:

If you cancel more than 2 weeks in advance, a full refund will be provided.

If you cancel within 14 days of the service: 50% of your payment is non-refundable, and 50% is transferable as a credit toward the cost of another event at Thin Place. Credits must be used within 12 months of the date of refund. After 12 months, any unused credits will be recorded as a donation.
We understand emergencies arise. In the instance of an emergency please contact kim@thinplacecommunity.com.
Member Services (Membership Plans):
You may cancel your subscription to Member Services (Membership Plans) at any time. Please note, this does not cancel your Plan immediately, rather your Plan simply does not renew at the end of the subscription period.
Failed payments will automatically cancel your plan. Please be sure to keep credit card information up to date to ensure uninterrupted continuation of plan benefits.
Email Subscriptions:
By voluntarily providing us with your email address, for example, if you sign up to receive an email newsletter (i.e., Weekly Article and/or Weekly Guide) or free product, you consent to our use of your email address for the purposes for which you provided it, as well as occasional emails regarding the site or other products or services we believe may be of interest to you. You may opt out of such email communications at any time by selecting the “unsubscribe” button found in the email.

Delivering digital files:
When you purchase a digital product, the file is delivered to you as soon as your payment is received.

The download link sent to you is active for 30 days. After that, it no longer works.
